Terms of Service Effective date: 07/05/2026

  1. About our Site These Terms of Service (“Terms”) govern your use of thesweathouse.ca (the “Site”), owned and operated by Keith Ward (“we”, “us”, “our”). By using the Site, you agree to these Terms.
  2. Intellectual property All content on the Site (including text, images, logos, product information, and downloadable files) is our property or used under license. You may not copy, modify, distribute, or use content without our written permission.
  3. Accounts
  • You are responsible for your account credentials and all activity under your account.
  • You agree to provide accurate, current information and update it as needed.
  • We may suspend or terminate accounts for violation of these Terms or unlawful use.
  1. Products and services
  • Goods: Saunas, cold plunges, cedar showers, firepits, and related accessories.
  • Services: Rentals and related services described on the Site.
  • Product info: We strive for accuracy but do not warrant that descriptions or content are error‑free. If a product is not as described, your remedy is as set out in our Return & Warranty Policy.
  1. Orders, pricing, taxes
  • Order acceptance: We may refuse, cancel, or limit quantities at our discretion (including suspected fraud or errors).
  • Prices are in CAD unless stated otherwise and may change without notice.
  • Applicable taxes and shipping charges are shown at checkout.
  1. Payments
  • Online: Credit card (processed via Shopify Payments and/or its payment partners). We do not store full card numbers.
  • In person: Cash, certified cheque, or bank draft (where offered).
  • By submitting payment, you authorize us and our processors to charge your payment method. We may cancel or reverse transactions that violate law or these Terms.
  1. Shipping, delivery, and risk of loss
  • Delivery options, fees, and estimated timeframes are shown at checkout. Estimates exclude weekends and statutory holidays and may vary due to unforeseen circumstances.
  • Provide a complete and accurate delivery address. We are not responsible for misdelivery due to inaccurate information.
  • Title and risk of loss pass to you upon delivery to the address provided or upon handoff to the carrier, as applicable.
  • Freight/LTL items: Curbside delivery unless stated otherwise. Inspect shipments upon delivery and note any visible damage with the carrier; notify us promptly per our Shipping & Returns guidance.
  1. Rentals (if applicable)
  • Eligibility: You must be of legal age and provide valid ID and any required deposit.
  • Care and use: You agree to use rental equipment safely, as instructed, and return it in the same condition (normal wear excepted).
  • Damage/loss: You are responsible for damage, loss, cleaning fees, late fees, and replacement costs per our Rental Terms posted on the Site or provided at booking.
  • Assumption of risk: You acknowledge inherent risks in sauna/cold plunge use and agree to follow all health and safety guidance. Consult a physician if you have medical conditions.
  1. Returns, refunds, and warranties
  • See our Return & Warranty Policy on the Site for details on eligibility, timelines, non‑returnable items, and how to start a return or warranty claim.
  • If we cancel an order after charging you, we will refund the amount paid to your original payment method.
  1. Promotions and gift cards
  • Promotions are subject to the terms posted with the offer and may change or end without notice.
  • Gift cards (if offered) are non‑refundable except as required by law and are not reloadable or redeemable for cash.
  1. User conduct You agree not to:
  • Violate laws or infringe intellectual property or privacy rights.
  • Upload malicious code, attempt to gain unauthorized access, or interfere with the Site’s operation.
  • Use the Site to send spam or misleading communications.
  1. Third‑party services The Site integrates third‑party services (e.g., Shopify, payment processors, analytics). Their terms and privacy policies apply to their services. We are not responsible for third‑party sites or services.
  2. Privacy Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and share personal information.
  3. Disclaimers
  • The Site and its content are provided “as is” and “as available.”
  • To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
  1. Limitation of liability To the fullest extent permitted by law, Keith Ward and our directors, officers, employees, agents, subsidiaries, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data, arising from or related to your use of the Site, products, or services. Our total liability for any claim will not exceed the amount you paid to us for the product or service giving rise to the claim.
  2. Indemnity Except where prohibited by law, you agree to indemnify and hold harmless Keith Ward and our directors, officers, employees, agents, subsidiaries, and affiliates from claims, damages, liabilities, losses, and expenses (including legal fees) arising out of your use of the Site, products, or services, or your breach of these Terms.
  3. Consumer protection Where Ontario consumer protection laws (or other non‑excludable consumer laws) apply, these Terms do not limit your statutory rights. If there is a conflict, the mandatory provisions of such laws prevail.
  4. Force majeure We are not responsible for delays or failures due to events beyond our reasonable control (including labor disputes, shortages, acts of God, war, terrorism, epidemics, transport or utility failures).
  5. Changes to the Site and these Terms We may update the Site and these Terms from time to time. Changes take effect when posted on the Site unless otherwise stated. If required by law, we will provide additional notice.
  6. Severability If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.
  7. Governing law and venue These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You submit to the exclusive jurisdiction of the courts located in Ontario.
